Purpose and Scope

These terms govern the use of the namelaka.es website and the relationship with anyone requesting an order through it. This site works as a catalogue: it shows the bakery's products, their ingredients and their allergens, but it does not allow online purchase or payment. Orders are requested by WhatsApp or by phone, and are confirmed and paid for at the bakery.

How to Request an Order

Pressing the order button on a product opens a WhatsApp conversation with a message already drafted, stating the product you are interested in. That message is a request for information, not a firm order or a contract. An order is only confirmed once the bakery expressly accepts the request and states the price, quantity, date and collection time. We recommend requesting orders as far in advance as possible, particularly around holidays.

Prices and Payment

All prices shown on the site include the applicable VAT. Prices for personalised products or special orders may vary depending on size, ingredients and preparation, and are confirmed before the order is accepted. Payment is made at the bakery on collection, unless otherwise agreed. The owner reserves the right to change catalogue prices at any time; the applicable price is always the one confirmed when the order was accepted.

Collection

Orders are collected at the bakery, at Carrer de Cuba, 96, Mataró, on the date and at the time agreed. As these are fresh products made on the same day, please keep to the agreed time so that the product is in optimum condition. If you cannot come, let us know as far in advance as possible.

Returns

As these are fresh, perishable food products, and preparations made to order according to each customer's instructions, returns are not accepted on grounds of a change of mind once the order has been handed over: the product cannot be put back on sale. This does not affect your rights as a consumer in the situations described below.

Products in Poor Condition or Different from the Order

If a product is in poor condition, has a defect, or does not match what was ordered, please tell us as soon as possible, preferably within twenty-four hours of collection and keeping the product. We will look into what happened and offer you either a replacement or a refund of the amount paid. Nothing in these terms limits the rights that consumer protection law gives you in these cases.

Ingredients and Allergens

The product pages in the catalogue state the ingredients and allergens of each item. Our products are made in an artisan bakery where cereals containing gluten, egg, milk, nuts and soya, among others, are handled, so we cannot guarantee the complete absence of traces in any product. If you or the person the order is for has an allergy or intolerance, please tell us expressly when requesting the order and check with us before confirming it.

Complaints

You may address any complaint to the bakery, at Carrer de Cuba, 96, 08302 Mataró (Barcelona), Spain, or to info@namelakamataro.com. Official complaint forms are available to consumers at the premises.

Intellectual Property and Use of the Site

The contents of the site, including texts, photographs, logos and design, are protected by intellectual and industrial property law, on the terms set out in the Legal Notice. Use of the site implies acceptance of these terms and of that notice.

Partial Invalidity

If any of these clauses is declared void or ineffective, in whole or in part, that invalidity will affect only that clause or the part of it found to be void, and the remaining terms will stay in force.

Applicable Law

These terms are governed by Spanish law, in particular the consolidated text of the General Law for the Defence of Consumers and Users and Law 34/2002 on Information Society Services (LSSI-CE). Where the user is a consumer, any dispute will be submitted to the courts designated by consumer protection legislation, which as a general rule are those of the consumer's place of residence.
